Reservoir Pond Draft Rules and Regulations - Comments

The Select Board received comments from department heads and then from the public at its public hearing held on August 9, 2016 regarding the draft rules and regulations being considered for Reservoir Pond. Please find a synopsis of these comments in the attached document. The Select Board will be continuing the public hearing regarding this matter at its meeting on September 13, 2016.

Opinion regarding regulatory authority on Reservoir Pond

The Town of Canton is the owner of the property at Reservoir Pond pursuant to a certificate of title issued by Massachusetts’ Land Court. The Town may regulate the use of Reservoir Pond as the owner of the property and to protect the public health, safety, morals and general welfare through the Town’s exercising of the general police power.

In addition, municipalities may regulate Great Ponds in accordance with state law.

Reservoir Pond Public Hearing

The Canton Select Board will hold a public hearing on Tuesday, August 9, 2016
in the Salah Meeting Room, Memorial Hall, 801 Washington Street, Canton at 7:00 p.m. The purpose of this hearing is to discuss and consider whether to adopt the proposed future use regulations of Reservoir Pond and the findings of the MAPC report entitled Reservoir Pond: Current Conditions and Uses. 

Draft Reservoir Pond Regulations recommended by MAPC

The Select Board is requesting that the public review the proposed regulations of Reservoir Pond and provide any input via email to bos@town.canton.ma.us or U.S. mail to Select Board, 801 Washington Street, Canton, MA 02021.

The Select Board will hold public hearing(s) on this matter after the close of Annual Town Meeting. The hearing date(s) will be announced as soon as they are determined
